A technician comes to the home to carry out a study and\u00a0<strong>assesses the energy information of the property,<\/strong>\u00a0as well as issuing a report on it and it will be valid for 10 years.<\/p><p><strong>4.- Certificate of Occupancy- \u201c Declaracion responsable\u00a0 \u201c <\/strong><\/p><p>This\u00a0<strong>document confirms that the property meets the technical and sanitary requirements that allow minimum habitability conditions.<\/strong>\u00a0 It is valid for 10 years.<\/p><p>Having this document is<strong>\u00a0essential for registering water, electricity, and gas supplies.<\/strong><\/p><p><strong>5.- Real Estate Tax (IBI)<\/strong><\/p><p>This local tax is paid every year by the owner of the propert<\/p><p>When selling the home, it is important that the buyer can\u00a0<strong>check<\/strong>, with a document,\u00a0<strong>that the<\/strong>\u00a0<strong>IBI has been paid every year to show that the tax is up-to-date.<\/strong>\u00a0Thus, the next receipt will be the responsibility of the new owner.<\/p><p><strong>6.- Service bills <\/strong><\/p><p>You will have to produce copies of the latest paid service bills\u00a0 like for water, electricity and gas.<\/p><p><strong>7.- Certificate of being up-to-date with the Community of Owners<\/strong><\/p><p>When the property is part of a community of neighbours, the owners have to pay a monthly fee to meet the various expenses of the common areas<strong>.<\/strong>\u00a0Before proceeding with the sale,\u00a0<strong>the<\/strong>\u00a0<strong>property must be up-to-date with payments,\u00a0<\/strong>that is, without outstanding debts.\u00a0<strong>The secretary or property manager can issue a certificate to deliver to the buyer.<\/strong><\/p><p><strong>8.- Pending debt certificate and Registry cancellation in case you have a MORTGAGE <\/strong><\/p><p><strong><u>If the property is mortgaged<\/u><\/strong>, it will be necessary to get a <strong><u>pending debt certificate<\/u><\/strong>.<\/p><p>In this document,\u00a0<strong>the<\/strong>\u00a0<strong>financial entity indicates the amount that remains to be paid at the moment of the sale.<\/strong>\u00a0This amount can be paid before transferring the flat or house, or it can be assumed by the buyer, deducting it from the total agreed price. If there is no pending amount, the\u00a0<strong>debt cancellation deed must be registered so that the mortgage no longer appears in the Property Registry.<\/strong><\/p><p><strong>9.-\u00a0 Information from the Land Registry Office\u00a0 \u201c Nota simple\u201d<\/strong><\/p><p>Last but not least, it is highly recommended to include the nota simple provided by the Property Registry. It contains all the information related to the property: who the owners are, where it is located, the characteristics of the property, and if it has any mortgage or other type of charge.\u00a0<strong>Including this document provides maximum transparency from the first contact with the buyer.\u00a0<\/strong><\/p><p><strong>In\u00a0 EASYLEGALS <\/strong>\u00a0we take care of MOST OF THE LISTED DOCUMENTS required for the sale such as :<\/p><p><strong>\u00a0<\/strong>Energy Efficiency Certificate<\/p><p>\u00a0Certificate of Occupancy- \u201c Declaration responsable\u00a0 \u201c<\/p><p>Certificate of being up-to-date with the Community of Owners<\/p><p>Information from the Land Registry Office\u00a0 \u201c Nota simple\u201d<\/p><h2><strong>WHICH COSTS AND TAXES WILL THE SELLER\u00a0 BE FACED WITH :<\/strong><\/h2><p><em>1.- <strong>Plusval\u00eda tax<\/strong> (Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana)<\/em><\/p><p><em>It is a <\/em>\u00a0local Spanish property tax levied on the increase in the value of urban land when a property changes hands payable by the vendor for the years the seller owned the property .<\/p><p>It is payable directly to the <strong>local Town Hall (<em>Ayuntamiento<\/em>)<\/strong> of the municipality where the property is physically located<\/p><p>2.- 3 % NON RESIDENT TAX OVER \u00a0THE VALUE OF THE SALE OF THE PROEPRTY :<\/p><p>When the seller is a non-resident in Spain and sell a property, the buyer is legally required to <strong>withhold 3% of the total purchase price<\/strong> and pay it directly to the Spanish Tax<\/p><p>This 3% retention is not a final tax; it serves as an <strong>advance payment toward your potential Capital Gains Tax (CGT)<\/strong> to prevent non-residents from leaving the country without paying their tax obligations.<\/p><ol><li><strong> How the \u201c3 % Retention \u201cProcess Works<\/strong><\/li><\/ol><ol><li><strong>At the Notary:<\/strong> When signing the public deed of sale, the buyer pays \u00a0the seller 97% of the agreed purchase price and holds back the remaining 3%.<\/li><li><strong>Buyer&#8217;s Deadline:<\/strong> The buyer must deposit this 3% with the tax authorities within <strong>1 month<\/strong> of the sale date, using the Tax form model 211. The buyer must provide the seller with a copy of this paid form as proof.<\/li><\/ol><ol start=\"2\"><li><strong> Calculating the Final Capital Gains Tax<\/strong><\/li><\/ol><p>Non-residents face a flat <strong>19% tax rate on the actual net profit<\/strong> (capital gain) made from the property sale.<\/p><ul><li><strong>Net Profit<\/strong> = Sale Price (minus selling expenses\/fees) <strong>\u2013<\/strong> Original Purchase Price (plus original purchasing costs, taxes, and home improvements<\/li><\/ul><ol start=\"3\"><li><strong> Filing Your Tax Return (Two Possible Scenarios)<\/strong><\/li><\/ol><p>The seller has \u00a0a strict timeline of <strong>4 months from the sale date<\/strong> to file the \u00a0final non-resident tax return using Model 210 on the Tax Agency Portal.<\/p><ul><li><strong>Scenario A: Your 19% CGT is higher than the 3% retention.<\/strong> \u00a0The seller \u00a0must pay the difference to the Spanish Tax Agency when you file Model 210.<\/li><li><strong>Scenario B: Your 19% CGT is lower than the 3% retention (or you sold at a loss).<\/strong> The seller is entitled to a tax refund of the difference from the Spanish government<\/li><\/ul><p><strong>EASYLEGAL WILL BE HAPPY TO HELP YOU TO PRESENT YOUR TAX RETURN <\/strong><\/p><p>3.- Latest service bills ) like for water, electricity and gas) , Local tax ( IBI) and community fees<\/p><p>Plus all the before mentioned documents ( Energy Efficiency Certificate, \u00a0Certificate of Occupancy, Certificate of being up-to-date with the Community of Owners) if there are not available or have expired the date of the sale.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>How to sell a Spanish property Easy Legals\u00a0 Lawyers Member of the Law Society of Orihuela N\u00ba 1089\u00a0\u00a0 &amp;
